I'd be very careful of the 'give backs'. I'd be willing to bet the biggest piece of paper TMC will ask you to sign will be a release of any and all liability for past acts by TMC. Others have questioned the legal authority to actually do the buy back. Which are valid concerns. But if the owner had signed a release that may survive the failure of transfer of title. Just me 2 cents.
