King's Creek Plantation Unethical Sales Tactics

Was your sales person named Ric Lainhart by chance ???

Ric Lainhart was, indeed, our sales person. Is he still there scamming unsuspecting folks?

No, he is not! They must have gotten enough complaints, ours included, that they finally got rid of him. Unfortunately, he left behind a mess for all of us who bought based on his lies.

That is so unfair. Most of us that do sales are always honest, we have the best product, we have no reason to tell lies, I and many of our co-workers feel the same way, I could not do a job if I had to tell lies, that is so ridiculous, there is nothing better out there, if you say you were lied to, it must be your own misunderstanding, you never mentioned any details, so you either were not listening very well or you misunderstood details.

Are you kidding me? I have rehashed the details many times. Just talk to the folks in owner's services. You will find that I certainly did not misunderstand what Ric Lainhart told me! Not all timeshare sales people are honest! Ric Lainhart is one of them.

This is why all promises made by a timeshare salesperson in a presentation should be made to be included in the written contract as that is the only that holds water in a court of law.

I hate to be the bearer of bad news but if you still owe money on it, you will not be able to give it away. No one will want to take on payments of a worthless timeshare. If you want to get rid of it, first of all pay off the mortgage and any maintenance fees owed.

Once you have everything paid off, try advertising here on RedWeek or other reputable timeshare websites that you want to give your unit away. You might have to offer to pay the closing costs and even the following maintenance fee as an incentive for the new owner.

The other thing you could do is negotiate with the resort and your mortgage lender to take your unit back. With that, they might ask you to pay closing costs.

But whatever you do, never ever pay anyone a large, upfront fee to sell, rent out, market, or "cancel" your timeshare. You might see or receive many offers from so-called "law firms" "consumer advocates", timeshare experts", etc. who claim they will be able to "cancel" your timeshare or mortgage. Many are scams. Other at best are sketchy. You will probably see many shills on these forums claiming that a law firm magically "cancelled" their timeshare and mortgage for a huge fee.

Which lawsuit is that and who are "they"?

Just a word of caution. A lot of times in these lawsuits against timeshare companies and sales people, it's usually the lawyers who make the money and the plaintiffs come away with very little, even if the plaintiffs win.

Ric was fired years ago. He was the boxer with brain injuries and hard to understand. He was only there a short time. Just use your product for vacations, that is what it is meant for, not a get rich quick scheme. they have provided thousands of owners with many high quality vacations, that's why you buy it, to vacation at luxury resorts, not for making profit, staying in high quality places vs a hotel room and you will break even in about 7 years, then you can vacation for a very small maintenance fee, and the cruise program that you received that expired, was a promotional offer from the marketing company who called you, you needed to read the details, this has nothing to do with KCP's benefits, you buy this product to take vacations and change your life, nothing else.

Yah, unfortunately he was there to lie to us. King's Creek knew what was going on as we were escorted into a private room to meet with him, not the usual sales practice in a big room with all other sellers/buyers. His job was to get owners with multiple time shares to sell their existing time shares and buy at King's Creek. He had a company to sell our current time shares, but that ended up being a joke. When we called to speak with Julie about this scam, she told us she said she hired Ric as a "closer". The sad part for me is that King's Creek knew what he was doing and then wouldn't cancel the deal when we challenged it. So, they made money by allowing this to happen!

I would love to join the suite so let me know when and what I can do

I am also interested in joining the law suite. We bought a 4 bedroom time share 3 months ago for 20K plus. I was promised Week 32 and now when I tried to rent it, Week 32 is actually a floating week and not a fixed week. The salesman, Ben never ever mentioned about floating week when he was trying to sell it to us. Had we known that it was a floating week, we would have not bought it.

We were there yesterday. Jan/6/18. He is still there. Trying so hard to scam people. He had no luck with us. I find it strange that there are no pictures of him to find on the web. I think he is lying about everything.

He's not the only one lying. They told us when we settled with them that he no longer worked there !! I would love to go there and sit outside the salesroom and warn people to RUN !!!!!

We too feel that we were swindled by Kings Creek. What they told us in the sales presentation was not truthful. It was only said to make a sale. Now we feel stuck with a time share we don’t want. I would be interested in joining a class action suit if one is filed. Thank you Deanna Root

Unfortunately, only the written content of a contract means anything at all. Verbal representations made by deceitful sales weasels are just meaningless noise floating temporarily around in the air before just fading away forever. Even the contract itself likely very clearly states somewhere in writing that any and all verbal representations that are not also specifically reflected within the contract are not legally binding in any way. The sales weasels know and understand this perfectly well, so they feel completely free to lie and exaggerate and misrepresent the truth however they choose. I don't know how those lying parasites even manage to sleep at night, but clearly they do.

Class action lawsuits are neither easy nor inexpensive to initiate or file or pursue; don't expect one to just somehow magically arise to specifically address King's Creek Plantation. You would be lucky to find an attorney even willing to touch this matter at all, since it's likely a relatively small pool of potential plaintiffs --- to engage in a long and drawn out affair with the ultimate outcome entirely uncertain. I'm sure that is not at all what you want to hear, but it is the unvarnished factual truth just the same.

Westgate and Wyndham sales weasels are the undisputed "champions" of developer salesperson deceit in the USA (the sales weasels in Mexico are the undisputed WORLD champions). I personally have no idea if King's Creek Plantation is associated with either one of those two "reigning U.S. champions".

I'll also add that such lawsuits can be drawn-out. One big problem you would have if you try to pursue this is that you have to prove what the sales person said to you. It will come down to a matter of He said, She said. That's one big reason why people sign contracts, in case there is a discrepancy or misunderstanding between what was said and what the buyer might have heard.

Even if you do win, after attorneys' fees, there will be little left for you. Just read what happened with the lawsuit against RCI about seven years ago.
