RTU vs Deed Sales

What is the difference, We are going to sell our Royal Haciendas unit and we see other units for sale with RTU and DEED sales. Royal Resorts told us that our ownership is RTU (we owe nothing on the Unit), and we want to get rid of it completely.

Right to Use (RTU) gives you just that, the right to use it. It's not a real estate deed so technically, you don't own any property. Most units in Mexico are RTU due to a Mexican law that restricts the amount of real estate foreigners can own. Deeds are like your house and are real estate.

If you want to get rid of it, you should first make sure that you are up to date on your mortgage and maintenance fees. Once you do that, you can contact the resort and ask if it will take your unit back or cancel your RTU contract. The resort might ask you to pay the next maintenance fee.

RTU's usually also have a specific end time. At that time your right to use is done and you have no further obligations. Until that time is up you still need to either sell or give the membership to someone else to complete the term of use or make arrangements to give it back to the resort if they are willing to accept the membership back either with or without an additional fee. The terms of the RTU including any transfer fees should have been spelled out in the original contract.
