With all due respect, you can accept or ignore the following unsolicited advice as you may see fit, but I would suggest NOT making empty (and / or legally impossible) statements like this on the phone (or anywhere else, actually).
No one can file a "class action suit" as an individual, so by phone announcement of such an idle threat, you're only revealing to the company rep that you don't really understand the law and may not know what you can do next. In my view, it would be much better to not so openly volunteer and announce that......
I would suggest, instead, that you assemble your facts for coherent, chronogically organized, written (no phone calls) submission directly to the state Attorney General's office. Emails, Internet venting, etc. is never going to get your money back --- but some attention from the AG office focused upon the upfront fee parasites just might do so, since these maggots don't want any state attorney pit bulls breathing down their neck.
The squeaky wheel might get the grease, but the squeaking first needs to be heard by someone with the power and legal authority to actually HELP you.
I have followede up on this advice with Florida and contacted this unit, (Bureau of Timeshares at (850) 488-1122). I spoke with someone maned Eric, but anyone will do. According to his records there was only one other complaint called in other than mine which was back in March. He recommended getting with others who would like to consider a class action suit and get together on hiring an attorney. I can be contacted at i1r2@embarqmail.com.
