MUCH more easily said by a busy voice on the phone than actually accomplished in real life I'm afraid and, in my personal opinion, likely to be just a complete waste of your time and energy. Not to mention that most attorneys wouldn't touch these type of cases with a long stick, given the slim chances for success (and the lack of evidentiary documentation available --- quite often none at all, and the fact that these were all "voluntary" arrangements entered into in the first place). I'm not defending upfront fee parasites, whom I completely despise, I just hate to see you waste your time spinning your wheels with no chance of success. The input you got on the phone may very well have been offered with good intentions, by a busy person trying to send you off to bother someone else, but it was an unrealistic suggestion nonetheless.
Rather than the lengthy (and likely entirely futile approach) of trying to organize a class action suit, which is MUCH more easily said than done, you might consider contacting Haufman Associates, a consumer law advocacy firm used by others here on RedWeek to sometimes recover monies in these type of instances. Their phone number and web site can be found in these RedWeek forums with some searching. While I do not know the firm and I have no affiliation of any kind with them, others on RedWeek have reported favorable results using them. They will get their fee out of the recovered proceeds, at least as I understand the arrangement. They can help each individual who contacts them cvirtually right away, one at a time, so why bother trying to "organize" a group effort, the result of which won't be any better (and might not be nearly as good, actually).
Forget about a "class action lawsuit" --- you won't have sufficient numbers of adversely impacted people , the case quality, or find the lawyer able or willing to ever even be able to get the (doomed) case off the ground in the first place. Not to mention that it may well take you 2+ years to learn all this on your own for yourself.
Just my opinion, which you arecertainly free to absorb or ignore however you see fit. Good luck in any event.
