Manhattan Club Lawsuit
sueo79 wrote:Re-posting something I wrote on page 195....because it's important. This thread is hard to follow. Better to be on Facebook for updates and communication purposes....please join.Could i please suggest to those of you that are NOT part of the Facebook group to keep updated on the Manhattan Club - that you please join. This Redweek thread being over 195 pages is tough to follow - and you can't search for things here like you can within a facebook group.Request to be added to this ONE Facebook group (there is more than 1)....do this one: "Manhattan Club Timeshare Disgruntled Owners Group - (has a RED SCAM picture as the profile page).
For anyone that was interested in getting in touch with the lawyer Jean Marc Zimmerman - please email him to be added to that group. His email is JMZ@zimllp.com . The initial questionnaire from him is about to go out - some of you may have already received it. Filling it out does not mean you are under any obligation to do anything with him. He is trying to get a feel from owners on where they are at/current status of maintenance/ownership, your individual goals ongoing, while also researching strategy to use with future litigation for all owners and/or each individual. Thank you - and good luck to all of us! This has been quite a stressful ordeal for all of us! We did not deserve this
This Redweek fourm is not difficult to follow. Unfortunately some individuals choose not to to research past posts so they are not up-to-date on the updated information. Redweek has been involved in the Manhattan Club issue for many years and has provided credible, updated information for owners by time share professionals. While I think it’s helpful that everybody be open to all aspects of available information concerning the Manhattan Club issue, Redweek has been a reliable form of information for owners. Continuing to state otherwise shows a lack of understanding on the history of events.

the nys attorney general's deputies and offices should be instrumental in offering assistance and guidance to all of us who lost out in this so-called lawsuit. SETTLEMENT, WHERE DO WE GO FROM HERE? , ET AL.....WE NEED HIS HELP. i sent the nys attorney general (and gov cuomo) bob bilello's finely drafted letter (see page 189........or around that) of this INFORMATIVE FORUM. i used most of the contents of his letter, altered to suit my needs, and sent it to the nysag and gov cuomo. to date, i have received no response from either nys official, a disgrace to say the least. they could have, at least, acknowledged receipt of my letter, but not so.
in response to going on FACEBOOK for more up-to-date information: USELESS AND REDUNDANT. IT'S ALL HERE IN REDWEEK'S FORUM. if we redweek participants could get our collective acts together and inundate the nys ag's and cuomo's offices with our letters (again, reference bob's letter on page 189) we might get somewhere. unless we act as our own spokepeople's mouthpiece, we'll continue to seek other outside help (which has been tried by attorneys unsuccessfully at least three times since this MANHATTAN CLUB'S CRIMINAL FRAUD/SCAM was brought into the open) to no avail.
FACEBOOK currently has its own mega issues too deal with. we have over 190 pages of comments and testimony right here. why complicate our MANHATTAN CLUB issues by advising us to go elsewhere for more pertinent info? if one or a group of us could condense these pages into a whole, understandable piece, perhaps we'd get some well-deserved satisfaction and direction concerning our current dilemma. perhaps jeff weir would contribute his writing and journalistic skills in summarizing the bulk of these pages into an understandable treatise. the use of another component, FACEBOOK, would further complicate matters.

Considering Facebook issues in regard to stealing our personal information for propaganda purposes I switched from public access to my personal usage only in my FB; my friends just closed their FB sites. Therefore, personally, I prefer to stay with Redweek.

ChrisV - Honestly, I never tried to imply that this FORUM hasn't been good for all of you to share information over the years - but it's 198 pages and for me, I cannot keep up with all the requests for adding to the lawsuit (very time consuming effort), which tells me people are finding it HARD to find the POSTS where I have given that information many times already. I understand about Facebook privacy issues at the moment, but all internet sites use our emails hidden in the database even Redweek right? (you can be on Facebook and have a blank profile and a fake name if you want ) - but to FIND a post, it's way easier to use a search button there to find a post/information on a page!
For my purposes - I am just trying to get the word out about a new Attorney that myself and another owner have found - Mr Zimmerman, and we have spent countless hours trying to get that word out (even did a conference call for over 100 people) and i have spent hours of my own time giving him information and helping develop the on line survey, and hours more trying to continue to add people to the survey list. We have hundreds of email addresses ...and growing each week... the power that number provides is important! the survey has gone out to all on that current list. *if you want to write letters to NYAG office - that is your choice. i personally wrote a few letters to NYAG and judge Rakower - given the slap on the wrist they got and many issues not addressed I feel that it's time for legal action brought by us, as owners individually or collectively.
Final - For all we know, Eichner's lawyers look at this forum and facebook regularly. I will not lay our cards here for them to see - that is NOT how you win a case. We will not share any further lawsuit info on this here or Facebook (status or strategy) , and i can't keep policing the pages and pages of comments asking to be included in the Attorney's email/survey. My only goal is to build the numbers of owners for our Attorney's list. (JMZ@zimllp.com). If you are interested, please email directly. He will be following up after the surveys are reviewed.

I think people should do what they think is right for themselves. If they can't be bothered to look back a few pages on the Redweek blog to locate the attorney's email, there is a larger problem than the lack of navigability. Facebook won't help them as much as it helps an attorney looking to assemble a list of potential plaintiffs. Other folks just can't get enough of the MC saga and will happily be a (silent) part of any group discussion. IMHO, we also have a substantial number of readers/contributors here who are simply tired of the MC/New York experience or their ownership obligations, not uncommon for developments of a certain age, but very different from a legally actionable matter. Before I'm accused of shilling for the MC, let me say, I'm also sure that a good many owners were misled and lied to; the investigation and settlement made that clear; and many more owners were inconvenienced by the reservation issues. All this is true. But if there are 15,000+ owners and only 200 (roughly 1%) are sufficiently motivated to even register on the attorney's site (for all causes of dissatisfaction), I would say we've done well to have a settlement negotiated at all. Certain members of this group have "moved heaven and earth" to get the AG to invest their resources and to get this far. I am just very skeptical of the ability to move much further.

I agree with all you have said, particularly the last two sentences. And as you say and I agree, people need to do what is best for them..I for one will wait for the settlement, sale of TMC, etc. and in the meantime enjoy the club. It was stated nothing ventured, nothing gained, so true and you never know, so I sincerely wish those who are going to continue to try, the very best of luck!

For a bunch of so-called, smart New Yorkers, you people sure got screwed, but with no kiss. If your tax bracket is high enough, just write it off over 7 years, and walk away, all of you are spending too much time, find the general partner or partners and make their life miserable, NAG_NAG -NAG.

Ever hear of silence meaning consent? ?? Even though the 6 million dollar settlement figure is a pittance toward the losses incurred from the fraudulent actions/scam by Eichner and his cronies, do you really think the settlement would have even occurred had it not been for the persistence and prodding by the posters on this site?? They should be applauded rather than criticized.
Gail J.
not even sure of the gist of your comments, nor the sarcasm of "so-called smart new yorkers" (there are owners from south, central america, europe, et al........are they so-called........."smart"?) year right, just write it off over 7 years and walk away.....those who want out still own what they don't want; what would they be walking away from?............charles, what's your point? the criticism is purposeless.

Boy--Why didn't anyone think of that. 198 pages of comments and no one thought of that. (JUST KIDDING) Talk about someone who does not know what is going on!! Beware of people with simple solutions to complicated problems.

UPCOMING BOARD ELECTION - I just received the notification via email regarding the M. C.August meeting and I am disgusted. It is signed by Susan Eichner, President and there is still wording that refers to members being selected by the SPONSOR - isn't the Sponsor actually Eichner and his cronies? Can someone decipher what that notice is saying. Please enlighten me - I thought that Eichner and his crowd were to have no further dealings with the Manhattan Club.

tulipblossom,
quite often we think very much alike. i second your entire comment regarding EICHNER AND CRONIES, INC and i resent their letter sent to us with the boldness of them to disregard and defy the court order and directly show themselves as the sponsors/owners. (the letter/email was signed by STUART EICHNER, PRESIDENT.) WHERE'S MR SCHNEIDERMAN AND THE COURT NOW? will some legal entity (THE COURT) STEP IN AND JAIL THESE GUYS WHICH SHOULD HAVE BEEN DONE IN THE FIRST PLACE DUE TO THEIR CRIMINAL ACTIVITY, FRAUD AND SCAMMING? it seems this issue requires another lawsuit, this time in criminal court, and should include the district attorney.
