Manhattan Club Lawsuit
My timeshare is finally paid off and my maintenance fees are current. I am seriously thinking of selling (at a huge loss of course) just to get away from the outrageous fees. Should I hold off? will Blue Green bring these fees back into line? Will there be any difference at all?

Thank you, Jeff. This should be good news! Something is happening! However, my understanding is that this is a just a press release. An agreement has been finalized, but a closing has yet to take place. BG plans to acquire remaining unsold inventory but the management won’t transfer until 2021, so Eichner is still in on it. I note that 2021 is more than 3 years from the settlement date, but I suspect the administrator won’t want to jeopardize the deal over a few more months. I don’t think there was a line of buyers waiting. I do expect to receive some kind of formal notification from the administrator or from BG regarding their acquisition. On the other hand, very little involving the MC ever transpired in what I consider normal business practice. But this is progress.

All questions about Bluegreen purchase are understandable but probably premature, for many reasons. Here is the corporate phone number for Bluegreen: 561-912-8000. They are the only ones who can really address the longterm plans for owners. In meantime, AG still has jurisdiction, despite fact they they have not been very forthcoming with information for owners. This purchase puts the upcoming Board meeting into a new light; no doubt, the board will be expecting owner questions about the purchase, so we highly recommend owners not only attend, but come armed with all of your questions. In meantime, RedWeek continues to communicate with various attorneys who represent owners or are/were contemplating filing suit against the Board and Eichners. We will advise of any and all developments on the legal front as they surface.

With the announced sale of TMC to BlueGreen, now would be the perfect time to bring pressure to bear by commencing an owners' lawsuit against Eichner and his cronies. The last thing a prospective purchaser wants to hear is that the company they're considering purchasing is mired in a law suits. I recently returned the retainer agreement to Jean-Marc Zimmerman at the Zimmerman Law Group with the $1250 retainer. After being screwed by Eichner and his cronies, and then abandoned by the NY Attorney General, the only hope we have for getting any kind of justice is to go on the offensive by commencing our own legal action against the Eichner gang and TMC. This retainer represents half the maintenance TMC is collecting from each of us EVERY YEAR. I feel this is a small price to pay to have even a chance at any kind of justice. I urge all TMC owners to contact Mr. Zimmerman at jmz@tmcsuit.com, and ask him to represent you too.

Has anyone been researching Bluegreen?....I have been reading all I can on the internet and it isn't pretty. Both Consumer Affairs and BBB have a plethora of complaints against Bluegreen which echo the same complaints we have had about TMC. Fraud, having a hard time booking, bait and switch in terms of expecting to get a particular type of property and getting something much less...etc. (The original owner, a Harry Patten of) Patten Realty Corp which eventually became Bluegreen had a bout of bad publicity in the '80's for deceptive marketing practices and that seems to be continuing with Bluegreen. Will this be a hopping from the frying pan into the fire situation? Wouldn't be surprised to find out there is a connection between Eichner and Bluegreen.

I question how Bluegreen can assume the management contract for TMC which legally has been accused of fraud. The owners , and we still don't know how many there are legally, should have the right via a board of directors to renegotiate a new management contract. That would include at least half of the board members representing the TMC owners. . Otherwise we are just getting a new Villain to replace the old one.
I have friends who bought property from Bluegreen. They have nothing but contempt for an organization who lied to them and never fulfilled any of their promises.

TMC owners might be going from the fraud pan into the fraud fire with bluegreen:
the consumer affairs ratings were dreadful! fraud and lies were indicated most often.
received a C+ rating from the better business bureau.

Does anyone think that Bluegreen ils going to forgive the unpaid maintenance fees? I used to own a Bluegreen timeshare, and was lucky to get out.
Did anyone ever consider donating a TMC week to a non-profit? Not the whole time share just one year's week. The nonprofit would then raffle the week off for a fund raiser. Would the donation be considered a charitable contribution?

Williamm465 I did seriously consider and look into donating it. There was more than one reason I decided not to and it was 5 years ago...non profits are pretty picky, don't blame them and I didn't feel right about trying to pass my problems onto a non profit. You should look into it, maybe things have changed. And your idea about them raffling the timeshare off for a fund raiser is good also.

Thanks, Deborah. I think it's a mistake to turn over management to a group that has had business dealings before with the Eichners. I also think it is wrong to continue on with the present Board of Directors. That should have been corrected right away. The actual owners have absolutely nothing to say, which makes me think the AG's office doesn't have a clue as to what timeshares are! All the more reason why a new management company should have no ties with the Eichners. We need a managing company that is objective and has experience and will work for all the owners.

There is information online if you search "donate timeshare"....you will find a lot of info and some organizations who accept timeshares etc. I read that some organizations who will accept timeshare donations, may require you to pay a hefty fee up front if there is no value in your timeshare, like there are not with ours. However since ours is in a good location in Manhattan, that could be a plus Good Luck!
