Laurel527.....I gave one of my timeshares back in June of 2014 right before the investigation commenced. I have not had to pay fees, but I also have not had final papers or the $100 I was promised. I was told this could not happen until everything was settled. Lynne O'Donnell said the same when I checked with her not long ago. It is my understanding that at this time they cannot take back any timeshares as they are forbidden to do transactions of any kind until everything is "resolved". I would call Lynne O'Donnell in financial services to see if anything has changed lately.

I recently returned the retainer agreement to Jean-Marc Zimmerman at the Zimmerman Law Group with the $1250 retainer. After being screwed by Eichner and his cronies, and then abandoned by the NY Attorney General, the only hope we have for getting any kind of justice is to go on the offensive by commencing our own legal action against the Eichner gang and TMC. This retainer represents half the maintenance TMC is collecting from each of us EVERY YEAR. When I think of how much money Eichner has stolen from us over the last 10+ years, I get sick. I feel this is a small price to pay to have even a chance at any kind of justice. With the sale to BlueGreen just announced, now is the time for us to take legal action and bring pressure to bear. The last thing a prospective purchaser wants hear is that the property is mired in lawsuits. I urge all TMC owners to contact Mr. Zimmerman at jmz@tmcsuit.com, and ask him to represent you too.

here's BLUEGREEN'S email address; send them an email asking how their takeover of TMC will impact owners (especially addressing your own individual issues, e.g., exorbitant management fees..............or whatever other issues you personally have). also, GOOGLE BLUEGREEN: from what i saw, their track record is not too favorable. however, they MIGHT be reviewing their negative online image and attempting to turn it around. the takeover of TMC MIGHT (MIGHT) be beneficial to current TMC owners...............VERY "IFFY" BUT A DEFINITE POSSIBILITY. stretching this point, we may not need to establish a lawsuit if BLUEGREEN comes through for us...............AGAIN, "IFFY," BUT WORTH A LOOK-SEE. (a phone call to bluegreen's officers/management might even suit individuals' request for more information regarding how we owners will be impacted by a takeover.) i suspect there will be a near-future takeover of the current TMC board of directors by bluegreen which could be to our benefit, another "iffy" possibility. the only way to remove the various 'IFFIES" IS TO GET INFORMATION DIRECTLY FROM BLUEGREEN ASAP. If you are asking me, who has talked about the fact that I gave a timeshare back.....the best person to contact to ask if you can give back your timeshare is Lynne O'Donnell in Financial Services....she handled my take back....the Financial Services phone number is (it can be found on your bill) 800-532-4566 option 6 ask for Lynne.

Lawyer has received many checks - and it's still early. Bluegreen isn't going to change anything(and once lawsuits are filed - I bet they will pull out of the deal). - the reviews on them are bad and the Timeshare business is a fool's business. Many of us made a quick decision with TMC but that decision was made worse when we received 750 page bylaws in the mail and random way over average maintenance increases year over year / and they rented our our rooms to the public. They have already admitted to fraudulent actions ..... It's time to deal with this and stop waiting. NYAG won't be the answer. Bluegreen won't be the answer. We have to fight for people to be held accountable for their actions. If we don't - nothing will happen.

Why doesn’t attorney hold a meeting of interested clients so they can meet and have questions answered? Possibly at his location. That would also give people an idea of interest and possible pros and cons of moving forward. As many of us do live out of NY lead time would need to be given.

Anyone who discourages people to join the Zimmerman lawsuit(s) because some "salvation" is just around the corner and we should all wait is either kidding themselves, very naive or may have other motives. The NYAG has not accomplished anything, except have the Eichners admit their deceit and guilt. The Eichners's admissions of guilt mean we've all been duped. I have no idea if there's a statute of limitations on their admission, but if there is, then we can't afford to wait. Do you really expect some new owner who is already in the timeshare business to be generous and reduce the maintenance costs because us owners think they're high and unfair? I've sent in my money to Zimmerman and there are going to be lawsuits. Any new owner will have to deal with these lawsuits and obviously maintenance fees will rise even more. Seriously, you're best chance is to join the Zimmerman lawsuit(s) and have a chance.

Section III F. in Zimmerman's proposal seems to say they can ask for funds beyond the $1,250 either because not enough owners sign up (which makes sense but at least it will be known up front) or to "properly fund this litigation to prevent Defendants from trying to defeat us by outspending us using legal tactics such as excessive discovery." That seems open-ended. Is there anything that can prevent requested legal fees from going beyond the $1,250? Or at least excessively so?

Yes, the Zimmerman group will most likely do a conf call or meeting with "clients" only in the near future. And no, as a client I do not want to give the "public" (this forum is public)..any strategy info or a count so far of how many are going to pursue legal action. So, that answer will not be posted. fyi: Bluegreen will most likely not bring any good change - their reviews are terrible. and it may be worse!
