NO MORE DIRTY DEALS, SCAMS, LIES AND ALL THE RESERVATION TIME WE NEED WHEN WE (REASONABLY) NEED IT.....IN ADDITION TO A REDUCTION OF ALL MAINTENANCE AND FAIR REIMBURSEMENT OF ALL EXESS FEES WE OWNERS HAVE BEEN DUPED INTO PAYING OVER THE YEARS.

Are any owners who are going to the hearing on Friday willing to go the CNBC studios afterward for a TV interview? CNBC will provide car service.

Notes from the TMC first Court Hearing
The Attorney General’s office was represented by two young lawyers and an intern. This first session was mainly the TMC lawyers asking for modifications to the court order against TMC.
So many interested parties turned out the hearing was moved from a small room on the 6th floor to a regular courtroom. TMC had 8 lawyers. The Eichner family had three lawyers of the 8 representing them personally. There were seven TMC owners present. Five other lawyers were also there observing the proceedings. I spoke to two of the lawyers observing. The two I spoke to had clients who were in various stages of trying to end their contracts with the Manhattan Club. Lieberman, the court rep, presiding over the hearing, stated some of the hearing was open to the public but some parts, lawyer conferences, were not. He did say documents from the closed to the public hearing were available for public review.
The TMC lawyers asked for modifications to the AG’s original court order. The TMC attorney said TMC cannot pay their employees, their renovation contractors and their lawyers because their accounts have been frozen. The TMC lawyers said they could not pay 1400 people. The TMC lawyers said they could not meet their payroll of $148,000 per week. The TMC lawyer’s said the court order against TMC was in violation of labor laws. The AG’s office said they would review the request for modification. They adjourned to a lawyer’s only meeting.
TMC owners can make the difference in this case. The Attorney General’s lead attorney is sharp. But, the Attorney General’s office is out-lawyered 2 to 1 by The Manhattan Club. This is how TMC has been able to stop three class action lawsuits and numerous personal suits against them. Already, the TMC lawyers are starting to shower the AG’s office with requests for modifications. Next, will come the flood of legal motions from the TMC lawyers. There is a saying, "The best defense is a good offense."
We, TMC owners, need to supply the AG’s office will all the documentation we owners have.
The TMC lawyers said people don’t want to buy at the Manhattan Club now and owners are calling up refusing to pay their maintenance fees to a scam operation.
Side note: A huge SHRED-IT truck was on West 56th Street outside The Manhattan Club this week.

Thanks for the update. I sent a letter detailing the issues we have encountered when attempting to make a reservation with TMC, the outrageous maintenance fees etc, but what additional documentation should we send? Phone calls have been the primary means of communupication with TMC and these are nor taped. Will any of the victims of this scam, aka the Manhattan Club "owners" be deposed? By the way, I kive in Philadelphia suburbs and just received a mailer from TMC advertising a weekend in Manhattan in exchange for the sales pitch for an "all suites" property in NYC, aka The Manhattan club! All for $249.00 / night, While I'm paying $2500.00 for yearly maintenance fees for the same place in NYC where I can't get a reservation 9 months in advance!! I dont care how many high flying lawyers they have, the Manhattan club gang should be thrown in jail for the federal offense of mail fraud across state lines!!!

The Manhattan Club issues are now squarely before the NY courts. No need for owners at this point to go screaming into the night, or on the internet, to vent their grievances. All owners who feel damaged by their relationship with the Manhattan Club should contact the NY AG's office and tell their stories. The AG's case is the only action that has traction. The prior legal cases seemed to have many merits, but insufficient pleadings, apparently, to move forward. So the only recourse at this point is working with the AG, who launched his case against the Manhattan Club after and only after the state court case was dismissed on appeal by the appellate court. FYI, the NY AG on Friday was touting other actions and activities in NYC and NOT talking about his current action against the Manhattan Club.

I am going to file another complaint with the USPS against the Manhattan Club for mail fraud. I first heard about TMC from a mailer I received in Mass.

Considering the AG found reasonable cause to shut this operation down, any modifications would be more criminal on the AG's part. Sound like this owners will be digging in their own pockets to make payroll or their employees and contractors will be victims just like the owners. Goes to show you what kind of people these people really are! So now we will burden our employees because we scammed all the owners and got caught? WOW, jail time should be the least for these clowns. The AG should be securing all the personal assets as well right now. In this tread earlier, I gave all of you key points of where to find business practices the skate the "fraud" lines. Now let see if you present these articles to the "young" attorneys so they can subpoena the records to prove the case. Not only should you owners get your monies back for what your purchased, but all the yearly fees as well with "interest" may I add.

I just submitted a complaint to the USPS on line. I actually received a solicitation mailer from the Manhattan Club last week. Unbelievable that they are continuing to attempt to sell these units to unsuspecting consumers. It would be great to get them on one of their nefarious practices!
