Louie called me because I called the BBB looking for my payment. But to answer your question, IMO there is only one way the BBB could legally execute these restitution payments -- and that is by having ALL the information. You should call the BBB and ask them. Steve London is the primary and his boss' name is Ms. Plate. 215-533-6200.
This restitution payment is a real piece of crap for owners.

Ribert, we are in the same situation- made the mistake of joining RCI. Difficult to get reservations at gold crowm resorts. I wonder if RCI membership Will also preclude us from getting some of the 2nd and 3rd Eichner payments?? Did you ask AG office that question? Dee

Note: in regard to a civil suit: per Mr Zimmerman, the defendants(s) will likely defend the case vigorously, and seek dismissal of the claim on the merits, and thus with prejudice. the suggested approach seems to imply that you simply file a complaint and collect 25K - the litigation process does not work like that.

Mr. Solomon called me yesterday. He advised me that distribution of the first part of the settlement was based on usage information (including RCI points) provided by the MC. If I do not hear from the BBB and I believe I was deprived of the ability to use my time, I should provide my records of years and days not used. The BBB will compare my claim with the MC records of my use by contract number and by year. Then it's up to the BBB as claims administrator.
The second and third settlement distributions which have not yet been made, depend only on paid-up status during the years in question (2011-2014, inclusive). I expect they will be smaller because they will be divided among all paid up owners, not only those owners deprived of use.
As far as civil suits go, I respectfully submit that owners who have had difficulty following this blog will be unable to manage the civil suit process on their own, and would be better served by hiring a professional. Make of that what you will.

According to the settlement terms, the the 2nd and 3rd payments will be made in the 2nd and third years of the settlement (2019 and 2020, August). We logged year one of the settlement this past August 2018 and those who received payments have just been getting them. So it seems they are on track. The terms of the settlement are available on the AG's website.

So we have received 3 messages from Lynn O'Donnell, offering to take back our unit, forgive all maintenance fees owed and pay for closing costs. The last message urged us to contact her soon, as we are on the "first list" of "deed backs" and that once they move on to the "next list", we will lose the opportunity to do so and the "Time Share Association will proceed in any way they need to regarding the fees owed." Has anyone else received similar calls? What do you all think their game plan is?

I haven't received my paperwork or $100 I was promised, when I gave back one of my timeshares in 2014...the process was put on hold because of the investigation..it seems I should have had a resolution by now. Lynn O'Donnell has not returned my emails that are inquiring about this.

Lynne must work for Bluegreen now. How generous of them to be willing to take back timeshares, so they can turn around and sell them in their big, new sales center they are creating. Granted if one wants to be rid of the whole hot mess, it's finally a way to get out ....one saves thousands in ongoing fees etc. or paying more money some other way to get out of it, but don't forget the initial investment of $25-$30,000 is gone. Don't know how these people live with themselves.

The plan is to get TMC inventory from owners for $0.00 and sell it to BG for $$$. BG needs obviously the units to sell further for $$$$. Their "deedback" program reminds the sales pitch when we had to pay and sign under pressure and get the OP after the purchase. Wondering is TMC proving the '"deedback" program in a written form or we have to trust their words? Eichner's tricks continue...
