oh my, yes. their generosity totally overwhelms me.............almost as much as warm beer or cold toast. they have no soul or sense of anything approaching "fairness". if they want my share time, they'll have to pay me.

If an owner has not paid their dues to the Association how does the Timeshare Association forgive their debt to us? Do they first foreclose? If Bluegreen is the buyer and they sell the unit does that unit owner have to then pay the same fees or does Bluegreen use the unit for their point system and Bluegreen pay the fees?

type your reason for emailing her VERY SPECIFICALLY IN THE BODY OF THE EMAIL, and ask her to respond via email. you might even go far as to intimate that your DOCTOR (could even be a ph. d, not an md.) told you to stay away from "phone rays".............whatever. now you have part of a paper trail, and it's also on lynne's computer.

10/11/18. I lost $60,000.00 dollars paid the mortgage fully for the 1 bedroom TMC timeshare 2009 purchase thru a rep Judith Casao(something like that)...arrangement for payments thru Cris Anzonni(something like that)....I paid all the maintenance & taxes thru 2016 & stopped as the AG lawsuit found it was a ponsey scheme on Owners as tourists got reservations & I experienced repeated ‘not available ‘ for dates to book my week or usage for a night ....the bs I could use the gym facilities as a member weren’t honored...u had to be using your Week but the Business Office was available-although many times the fax machines didn’t work & the Front Desk would assist but then your privacy concerns were lost. The RCI pitch to exchange for elsewhere was a total waste-their Rep on site - turned out to be a lie as she never got anything exchanged .....I gave my points to an acquaintance.....It was stated TMC would purchase the Timeshare after the mortgage was satisfied but after the Litigation & this Bluegreen restructuring/ Lynn O Donnell says ....$10.00 is all that is being offered to take your name off the BS deed. It is unfortunate we Owners have no recourse as Lawyers for any type of Lawsuit find it’s an Ordeal - I did try to engage 1....Soo there is no Mortgage deduction for taxes & Real estate taxes are capped at $10k in NYS....It doesn’t do anything else for me .... sooo I am waiting for Lynn O Donnell to send me these papers that she says won’t be available for another 2 months... I have moved on thru this frustration & no longer will have anything more with this !

I am writing this in hopes that there are other TMC owners who are from California who are willing to discuss the steps they’ve taken to resolve this. My question is, have any of you spoken with an attorney regarding this travesty that has fallen in our laps. I too paid $60,000 for my penthouse and I am unwilling to simply turn my unit over to Bluegreen or whoever is making the offer to “take it back” and forgive all past due fees. That’s so very “kind” of them to “help us out” like that. I am determined to try to fight this! Why should I turn over my unit without recouping at least some of my initial outlay of money. Even if I get 50% of my upfront costs I would be willing to return my unit to “whoever” so they can resell it for $50k, which I’m sure can be done because I have a full 7 days per year per my agreement with TMC. I am contemplating entering the Zimmerman lawsuit however I am consulting with a California based law firm first so I can educate myself about the merits of doing so. I would love to hear back from my fellow Californians to see if any of you have taken this step. Thank you all for your willingness to share.

beckyf76, regardless of where we live, perhaps if we form our own COALITION OF FINANCIALLY DISTRESSED TMC OWNERS (COFDTMCO) as a real entity, we can all get together via email or even if via conference call. we can work on a strategy that can possibly be financially beneficial to all of us. it appears to be a total impossibility to get a list of all TMC owners from anyone who has it. if we can get this COALITION going, and get some media newspeoples' attention and "advertise " for us, we might be able to get a good portion of owners to join us. this could lead to getting the names and contact method to reach many owners (a list of most owners). so much of what's being said in this forum is GIVEBACK, GIVEBACK, GIVEBACK. we all gave mucho dineros, in payment for our weeks. THAT DOESN'T MEAN THAT MANY OF US (i truly am empathetic to those in such a big financial bind that it would be impossible to join us in my proposed coalition effort) CAN'T HOLD OUT GIVING AWAY OUR PURCHASE MONEY TO THOSE BASTARDS ONLY TO HAVE THEM RE-SELL IT AT A MEGA PROFIT...........AGAIN........

if i can garner some agreement to move forward with this plan, please let me know in this forum. we can share strategies and incorporate ourselves into a viable opponent to the TMC management, past or present, who screwed us royally and left us BEGGING TO GIVE BACK OUR INVESTMENT. i would offer my email address IN THIS FORUM to have owners come forward with their contact information, and i would start our own owners' list........perhaps this could mushroom into others offering their email addresses to share the chore of getting more owner names and contact information. then we can reach, hopefully, most, owners to assist with details of our plan.

Though it may seem like an impossible undertaking, I'm an optimist (though not tremendously computer savvy, which looks like a need these days), and would connect myself and spouse to such an effort. We signed a mortgage agreement purchasing 1/52 use of a one bedroom unit in Oct 2002 every year and in Feb 2003 added 1/104 use of another similar room every other year. Every class action suit crossing my desk seems to benefit the attorneys way more than owners. It's understandable because paying a retainer was the proposal put on the table and some/many (don't know the count) accepted the proposal.
Another path might be to come together, create an escrow account managed by an owner executive team to advocate/arbitrate this situation for TMC owners. Wrongful death, failed medical procedures, proprietary disputes, etc. are often settled this way with a 60% client/40% attorney, to a 75% client, 25% attorney split basis. More thought/conversation needed, but continues the train of thought (14,000 to 18,000 owners is significant).

I am interested in joining this lawsuit. This place is a real disappointment and got too expensive. Received my maintenance bill yesterday and it is double of what they said they would settle for in 2017. Please count me in Carol Fleres @carolannfleres@gmail.com
