Another path might be to come together, create an escrow account managed by an owner executive team to advocate/arbitrate this situation for TMC owners. Wrongful death, failed medical procedures, proprietary disputes, etc. are often settled this way with a 60% client/40% attorney, to a 75% client, 25% attorney split basis. More thought/conversation needed, but continues the train of thought (14,000 to 18,000 owners is significant).

hi carola665, many thanks for your response to the idea of establishing a coalition of owners...COALITION OF FINANCIALLY DISTRESSED TMC OWNERS (COFDTMCO), our first step is to get as many owners as possible to respond to this possible remedy of opposition to GIVING AWAY our TMC purchase investment. that's just what TMC wants which is a very financially sound desire for them: here's the scenario: keep maintenance fees so high, that owners will GIVE UP THEIR SHARES FOR NEXT-TO-NOTHING. next, we put their GIVAWAYS BACK ON THE MARKET FOR SALE....................AGAIN...................WOW, GOOD THINKING ON THEIR PART..................A NO-BRAINER, IF WE....................................GIVE............................OUR INITIAL INVESTMENT AWAY without a good fight, then we give away our investment and run.................AND THEY TAKE OUR HARD-EARNED INVESTMENT MONEY AND RUN TO THE NEAREST BANK TO DEPOSIT IT INTO THEIR ACCOUNTS.
WE MUST GET THE NAMES AND CONTACT INFORMATION OF AS MANY (A MAJORITY, IF POSSIBLE) OWNERS AS WE CAN.

hello carole487, yes, our finances are being hurt, some owners more than other owners, by the exorbitant TMC maintenance fees. i do not like the actuality of being robbed annually. that's the reason for my suggestion of establishing THE COALITION OF FINANCIALLY DISTRESSED TMC OWNERS. this entity could possibly afford owners access to a list of names and contact information of most/many owners. this information has never been made available to us owners; i believe that even the past new york state attorney general, eric schneiderman, couldn't obtain said list. (frankly, i don't believe he used all of the resources available to him. this so-called settlement was a pittance of what it should have been, so consider ourselves to still be victims of fraud and financially negative manipulation.) ................................................................................................ANYWAY,...........................................................................................
this COALITION could work if enough owners become involved. yes, we would all need to pitch in to collect names. this would involve our making our email addresses available for other owner responses with their names and contact information, i, e., names and/or email/phone info. a less likely alternative would be to use the redweek.com TMC forum thread to accomplish the collection of this information.
i need responses/feedback from as many owners as possible active in this forum, to get the process of forming this coalition underway. comments, addendums, suggestions, expertise and a desire NOT to be continually SCREWD BY TMC are obviously essential. our efforts could be funneled to various media, e.g., newspapers, tv news stations, et al. with "news tips" made by emails preferably, or phone contacts. THE CASE WAS "SETTLED" (LOL) BUT THE LEGAL ISSUES LINGER. i think that if over 10,000 owners made their voices heard via this COALITION, someone, somewhere will take active notice. we have nothing to lose by trying this strategy.

Chrisv126 I Am with you on this! There is strength in numbers and this coalition you’re suggesting may be just what we need to get something going. I refuse to simply hand my unit over to “them” without a fight. We have all been screwed over long enough. What can we do to get this started? Obviously we need to speak with each other or communicate via email. Any ideas?

let's get this project moving quickly. if we do it right AND WITH THE COOPERATION OF AS MANY OF US AS POSSIBLE, we can pull this idea off. do what you think is best: send your name and email address or (less preferred) your phone number; offer amendments, additions, deletions, other methods...........whatever you think needs to be done to get us on a roll. certainly most of our ideas can be incorporated into a united and victorious whole. i don't consider myself to be an expert organizer, so the very creative ideas of all owners will be considered toward our winning end. we can all fight windmills and make others love us LIKE OUR FRIEND "DON QUIXOTE DE LaMancha" with lots of help from his sidekick, sancho panza..........others who will join us in unison to DREAM "THE IMPOSSIBLE DREAM" of coming out of this mired financial mess smelling like flowers instead of stinkweeds.

hello tulipblossom, as far as i know, no list of owners is nor has been forthcoming either from zimmerman or the non- sponsored board members (who i believe to be mere puppets, voiced and mobilized by their masters, the SPONSORED BOARD MEMBERS and not " overseeing the management of the Association on our behalf.") in the past 4 years, i think i have seen one posting from one non-sponsored board member. i believe they are on the board for their own reasons and/or they are being silenced by the sponsored members........just food for thought.
i may be mistaken but i haven't been made aware of any list of owners that is available for all owners' perusal...............have you? perhaps zimmerman has a plan to obtain this owners's list, but if so, i haven't heard about it.
these are among the reasons for my suggestion of the formation of a COALITION for the purpose of developing such a list of owners. if a list becomes available, obviously the idea of a COALITION becomes moot, unless owners want to use if for purposes of communication personally with one another......A GOOD IDEA IN MY OPINION. the more we have the availability to speak with one another, the more vociferous we might become for correcting various complaints and issues, e.g., exorbitant maintenance fees prompting some owners into GIVING THEIR PROPERTY BACK TO TMC, only to have them re-sell it doubling their profit. not me!

hello drusillam2, thanks for the update. i hadn't heard about zimmerman's court date. exactly what date and time is this court appearance? i believe we should proceed with the idea of a COALITION as i described, and we should start work on it NOW. if the court doesn't rule in zimmerman's favor, owners will have yet to begin work of getting our own list in our own way. we don't know the date, unless you can provide it. if the date is not within a week, i think owners should get started with our COALITION plan (which i think should be done in any event). once that list is established, owners will have the option of communicating with other owners to share information and strategies for our benefit. even if zimmerman gets the list, sharing it will all owners will be a long time coming. let's proceed diligently with the COALITION PLAN and not put it off any longer.

hello bettyl171, welcome aboard our COALITION VICTORY SHIP. i see owners getting revved up concerning our plan. it appears that many of us, so far, are willing to offer their efforts in behalf of all of our brother and sister owners. if this list comes together as we all think it will, it will serve us well in communicating with each other personally to plan strategies to conquer the enemies and to hopefully prevent further GIVEAWAYS of the ownership that we paid for with our hard-earned monies. one of the goals must be an effort to reduce maintenance fees substantially, again to help prevent GIVEAWAYS only to be resold by TMC AGAIN.
as briefly as possible, my suggestion for owners' consideration follows: the united states could be divided as such, e.g., northeast, southeast, mid-west, etc, the size of the division to be determined per the owners wishes. the next step would be to use redweek.com to get the message across that owners in the northeast contact one of our volunteers assigned to collect contact information from that part of the united states. that's my current thinking. if any owner reading this has a better way of building our list of owners, please come forward and offer other means to do this.
we need to do more thinking on this matter, but it seems that many of us are on the same page regarding positive outcomes of our plan.

This morning I received an email from an owner who wants to join our coalition. He emailed directly because he is unable to actually post on Redweek but he follows the blog. So as of this morning, we have 2 additional names to add to our growing list.
