Manhattan Club Lawsuit
gail, ok. (1) who has joined the zimmerman lawsuit? (2) what have you been told, are the proposed goals of his possible lawsuit? i was invited by gail, who indicates that she has joined, to ask the first question. my second question is for clarity and transparency of purpose

just to loosen things up a bit and put some of our hostilities aside, here's a "blast from the past". it's really not funny, but a rather interesting note. check the date it was written: are we not in somewhat the same sinking ship as some of us were when this was written? it's from PAGE ONE (1).

I wish you all the best with this suit. I came to end of my MC rope when fees had increased from apprx $500/yr to just under 2 grand in 10 years with no end in sight and being told that there was no vacancy when I would call for time. So, I "reversed sold" my share back to the Club. It was worth it, to end all the hazzles including fraudulent use of my cc by some one at the club, and consequently being harrassed to pay, by credit!, the fee and RE tax, months in advance of my anniversary date, which was stated as THE due date on my contract. I am so relieved to be out of it. Best wishes.

if we pursue our goals with diligence and vigor, via whichever paths we choose, maybe we can change "NEVER change!!!) to "HAVE FINALLY CHANGED", a comfortable, if not challenging weekend thought!

Gail J. Yes Chris V. has done plenty but he/she posts too frequently, is too verbose and sometimes sounds unhinged. Just on page 326 for example, 9 of the 20 posts were from Chris V and on each of pages 327, 328 and 329, 6 of the 20 posts. Skipping past them is easier said than done, but I have been doing that for the last week or so. I know that I am not the only reader rolling their eyes at the lengthy, difficult to sort through posts.
However, there has been an attempt at brevity. I hope it will continue. My objective is to be free of the TMC and no longer have the maintenance fees to pay.
It is my personal opinion that who and how many have joined the Zimmerman lawsuit should not be discussed on this forum.

Why not just skip over Chris's comments? You don't HAVE to read them. I always used my weeks because you can learn to live with the requirements. Either bank way ahead, bank them or rent them. What I continue to be unhappy with is, that even after 20+ years the developer didn't turn the board over to the owners. The other objection, of course, was the out of this world assessments. There are other timeshares now in NY and hotels where you can stay for way under $3000!
I just closed on my Junior Executive biennial. I went through a Mickey Mouse of a deal but it was worth it. I may do something similar with my every year 1 BR. I'm not sure this new management company is going to be much different than the last!

sharon, i agree that brevity in composing submissions on RW is not one of my strengths. however, the "unhinged" part of your critique of my writing escapes me. but, of course, personality traits of a writer lie in the eyes of the reader, inaccurate though they may be.

No doubt Chris has been a great part of the forum, certainly as measured by volume. And he gives lots of advice. I leave it to anyone who has taken it to say how good it is. What is consistent is that he keeps talking about "retribution" and uses lots of legal sounding phrases and accusations of "proven" crimes - even though this is a civil matter and he's no lawyer. He spent weeks vacillating on whether or not to retain Zimmerman and complaining about not receiving answers or responses to his questions before he retained him. Now he is the "co-founder" of the grandiosely named "coalition" which muddies the waters further. It has goals but no means to accomplish them, does not help the existing effort, but provides the illusion of action for those on the sidelines. I believe there is a strategic reason Zimmerman has not disclosed how many clients have retained his firm; most likely he has also advised his clients not to make public statements. So what might your objectives be?

nathan, begin with BREVITY in the comments you made right here. it doesn't describe the length of your paragraph. you might want to revise it to make it shorter. yes, i offer MY OPINIONS (WHICH I HAVE CLEARLY STATED DO NOT EMANATE FROM ANY LEGAL EXPERTISE). and yes, how good my advice depends on owners wishes to think FOR THEMSELVES about their choices (i hope you believe in owners' CHOICES) of how they want to proceed in making themselves financially sound again, a privilege removed from them by EICHNER/TMC in the timeshare arena. the former litigator, nysag, eric schneiderman proved business TMC fraud (a crime, as i believe he stated) by his undercover investigators posing as purchasers and sitting in on sales presentations. this information was used in his legal presentation, albeit the end results of his case were beyond unsatisfactory, a SETTLEMENT, indeed..........worthless. "and uses lots of legal sounding phrases and accusations of "proven" crimes" your quote...........fraud was proven, not by me but by the nysag. yes I spent time considering my legal options. am i not permitted to chose my path AND TO HAVE OTHERS CONSIDER IT AS WELL? are you suggesting that owners who joined our COALITION are not able to think for themselves and to follow another unproven path? and again, yes the path of COALITION is currently unproven, as is mr zimmerman's. and si (to add some variety). the COALITION and its followers are not so nieve (and followers were made aware of the following intention) to believe that we could proceed eventually without attorneys directly qualified (via our research) in timeshare litigation. will we succeed? naysayers obvious say no. will owners and zimmerman succeed, up for grabs as well. also, please look up the word COALITION. it encompasses people with similar ideas to reach specific goals. if you wish to give it a GRANDIOSE MONIKER thanks; it makes appear so much more GRANDIOSE, which was never our intention, but again, thanks. the COALITION HAS NO SECRETS or anything up our collective sleeves. we are upfront, truthful and honorable in this forum and with our group of owners. if anyone believes we are concealing any hidden agendas or motives, please ask us to stop. we are, by no means in competition, with any other entities that are working in all owners' behalves. please delete that from your memory banks. in fact if we were asked to join other paths to reach similar goals, we would welcome the opportunity to consider that option.
until then, i will be (as i have been made painfully and boringly aware of) wordy in my comments, overpowering brevity as i find essential and necessary. fyi, i have enrolled in BREVITY LESSONS SEMINARS starting in 2025.

I have joined the Zimmerman lawsuit.
Moreover, I see no purpose in joining another group or coalition without any resources, little real focus, and zero leverage.
On the other hand, if it makes them feel better to thrash around, I have no problem with skipping over the rants.
I believe that most people following this topic are smart enough to know that this new coalition is going nowhere.

My problem with all of this is that many are right - we have covered so much of this in the past . It's been pointed out that various previous class action lawsuits went nowhere. Then we learned of the willingness by the Zimmerman law firm to become involved in our plight and it appears to me that they are making some progress. So - now some are proposing that they pursue other avenues and then perhaps retain a law firm in the future or possibly join the Zimmerman law firm. I made the decision to join the Zimmerman lawsuit and so far have no regrets. If I understand correctly, there will be a hearing on a motion in December to compel the M. C. to release a list of the owners. To me - that is progress and at least the law firm is doing something productive. Now, as I see it, owners can continue spinning their wheels and rehashing all the wrongs done to us or they can remain silent or they can become a part of the Zimmerman lawsuit. A adage that I have followed all my life which holds true today is that "successful people find ways to do things rather than reasons not to".
