"He {louis solomon} is the person who is (sic) supposed to enforce the execution of the NYAG orders." where has he been since the penalties were imposed AND IGNORED by the TMC PRINCIPALS? shouldn't he be held accountable for upholding the court's ruling............if that is, indeed, his job/function? he is a deputy of the office of the new york state attorney general, lititia james. if your comment is correct, we should all be clamoring for her to have her deputies do their duties as they get paid to do.

hello,

the phone number i found for louis solomon is ................................. (212) 416-8109.

i called today and got his voice mail. this is, in fact, his office number at the office of the new york state attorney general. we should all call him if he is indeed in charge of the enforcement of the settlement requirements as eric schneiderman/the court litigated them. TMC seems to be flaunting authority to do other than the mandated terms of the settlement gained by schniederman, former nys attorney general. fyi, the current nysag is letitia james.

I sent an email and letter to Zimmerman about joining the lawsuit, if that is still an option and if we are eligible. We have been owners since 5/2006. We have been able to use the facility once, booking out 12 months in advance. When we purchased we were "strongly directed" to use the RCI points. Initially that worked but we could never use the points allocated. It has been increasingly difficult to book where we would like, when we would like with RCI. The quality of their units is very uneven. Each time we have been pressured to participate in another time share purchase plan. With the management fees increasing yearly with both Manhattan Club and RCI we just want out. Cheryl

Good Evening,

I am writing to update you on our efforts to secure access to TMC’s member list and its books and records in the two actions pending in NY State Supreme Court.

In the Tucker v. TMC case, TMC’s counsel advised the Court during a hearing on April 3, 2019, after the Court demanded that TMC finally indicate the cost, that TMC would charge Mr. Tucker $10,000 to send a communication on his behalf to TMC members. Unfortunately, thereafter TMC refused to advise how many members it would be e-mailing and the cost per e-mail to do so, despite being asked by us several times to answer those two questions. Instead, TMC filed a motion last week to dismiss Mr. Tucker’s complaint, which we will vigorously oppose. Incidentally, we obtained a price quote from an independent vendor to send out 10,000 e-mails on behalf of Mr. Tucker for $1 not $10,000.

This past Friday we filed a reply brief in the Bodoh v. TMC case. Copies of those papers will soon be available for your review via a Dropbox link to be provided. Significantly, these papers refer to and cite portions of the Second Affirmation of Assistant NY State Attorney General (“NYAG”) Serwat Farooq filed in an action against TMC’s former Sponsor in 2014 that describes in great detail the NYAG’s findings regarding the deceitful and wrongful sales practices and conduct associated with the management and operation of TMC.

Messrs. Tucker and Bodoh are continuing their independent efforts to expose and investigate the serious wrongdoing at TMC.

We will keep you informed of future developments.

I talked to Louis Solomon on 4/12/19. I had called re 2nd payment from the AOD agreement. I left a message and his voice mail said he would return the call within 48 hours. He called me in 24 hours from 212 -416-8109. He said the payments sent a few months ago were FOR THE FIRST payment. The 2nd payment has been received from Eichner and it will be a few more months before those funds are disbursed by the Better Business Bureau. In view of TMC advertising on Hosteeva, etc perhaps we should all hound Mr Solomon with questions as to why TMC is allowed to continue and escalate their actions.

I have joined the Zimmerman lawsuit and I consider it to be the best option for all of us. Is anyone else as concerned as I am about the claim Fibo N. made earlier in this blog about TMC employees setting up a new LLC in New Jersey to continue their dirty deeds? TMC has EVERY OWNERS personal information to include SS#, credit card information, DOB, address, etc. This seems even more frightening if they truly are continuing to screw us all!

Bob, thank you very much for posting the court documents. Let's say, Mr Bodoh and Mr Tucker disseminate their messages to the owners (whatever the message is) and get access to the books and records the fraud of which was investigated and presented in Farooq's filings, NYAG investigation, and partially in the AOD. Let's say, Mr Bodoh and Mr Tucker will be voted and selected to the TMC Board. What are their perspectives in regards to the EXIT point for those owners who want to EXIT?

Irene, I did see that on FB. I hope everyone on this site reads the Second Affirmation by Assistant NYAG Farooq which is included in the documents that Jean-Marc shared with us. This document is EYE OPENING and SICKENING to read. The NYAG has allowed Eichner/TMC to get away with ignoring demands to provide documents that were to help to complete the investigation and those demands WERE NEVER MET! So the way I understand the document the investigation was NEVER seen to completion. If any of us were to ignore demands such as that we would be sitting in a jail cell next door to Bernie Madoff! It just sickens me to that I, and all of my fellow owners, could have gotten caught up in this total scam. And what sickens me more is that Eichner got a mere slap on the hand. The restitution he had to pay was nothing compared to the hundreds of thousands of dollars he and his cronies siphoned off of the Homeowner Association funds! Utterly disgusting!

Becky et al: the NYAG investigation contains 430 documents. The Second Affirmation by Assistant NYAG Farooq you were reading is not the last or final one, it's the document No 380. The entire investigation is publicly available via NY E-courts; don-t forget TMC has involved the best attorneys who were fighting fiercely against the investigators of the NYAG Office. You might familiarize, for example, with the another doc No 411 where investigator Farooq stipulates that:

"Respondents Have Withdrawn Millions of Dollars from Urban’s Bank Accounts to Pay Legal Fees and Other Expenses that Are Unrelated to the Timeshare Association"

"THE RESPONDENT ENTITIES HAVE UNCLEAN HANDS"

"The Frozen Funds are Tainted by Fraud and the Escrowed Monies Are Being Held for the Benefit of Others", etc.

i found my recent phone experience with louis solomon, deputy new york state attorney general, to be less-than-helpful and quite fruitless. i hope others who call him have a better experience than i did. he offered no empathy nor a desire to be of any assistance, even when simply asked about his function of ENFORCEMENT as a deputy in the office of the nysag. he said he was in charge of enforcement. that was it. helpful? duh............not at all. his only comment, obviously frustrating, was to file another complaint with the new york state attorney general.............as if i didn't know of that option

let us all know of the satisfaction level you experience should you decide to call solomon.

TMC was supposed to pay restitution to owners based upon what days/weeks they were unable to use the timeshare. 3. Bluegreen would be buying out TMC

louis solomon, deputy ny state attorney general in charge of ENFORCEMENT (he didn't explain to me exactly what that meant) must be feeling the heat of our legitimate phone calls to him, for which new york state is paying his salary via our state tax money (i'm from ny state!!!) to me, he sounded very edgy and somewhat annoyed that i called. i received much less, if any information from him. you, at least received some information. basically, all i got from hi was a suggestion to file another TMC complaint with the new york state attorney general's office. additionally, he might not even be accurate in his comment to you that " Bluegreen would be buying out TMC." i seem to have heard conflicting stories about that. my experience.......fruitless; you at least got answers, inaccurate as they may be.
