Manhattan Club Lawsuit
IN HONOR OF THE CURRENT JOVIAL SEASON, I WANT TO PUT THOUGHTS OF THE MANHATTAN CLUB ON THE PROVERBIAL BACK BURNER (DON'T EVEN THINK I'D FORGET ABOUT IT ALTOGETHER!) AND WISH ALL OWNERS AND OTHERS OF GOOD WILL A PEACEFUL (I'LL ADD NON-VIOLENT) HOLIDAY TIME. HAPPY AND PEACEFUL NEW YEAR AS WELL. ASIDE FROM OUR MC FRUSTRATIONS, WE CAN COUNT OUR FAVORS AND BLESSINGS, AS WE SEE THEM; "CHACUN A SON GOUT" (WITHOUT THE ESSENTIAL FRENCH ACCENT MARKS.)
cynthias402 wrote:Yes, I agree with your math. The timeshare came to me by a transfer of assets from a family member, so I didn't pay the 25k. I apologize...I shouldn't have mentioned it. However, I still think there is value in the boutique hotel. I like the location, I like the "club-style" atmosphere and I love having 2 full baths. I'm willing to put a few hours into getting this straightened out. Who's with me?

Merry Christmas and a great holiday season to all redweekers. We'll have another installment on the Manhattan Club's twists and turns, including info about a lender threatening to foreclose and a $500K escrow fund established by the Attorney General's office to protect assets, next week.

irene, i doubt that it's the MANHATTAN CLUB TIMESHARE owners' goal to "shut the manhattan club down." it appears to me that our ultimate goal is get a monetary settlement concerning the fraud and lies perpetrated by the MC to get prospective purchasers legally bound to DEEDED ownership. this would include our inability to use the MC with our reservation rights, the excessive and exorbitant maintenance fees and other monetary issues concerning the alleged MC FRAUD. it should also include our inability to sell our timeshares at an at least fair market value rather than give it away for $1 or, if we keep it, to continue paying maintenance fees and not be able to get the reasonable reservation times we paid for originally........to my recollection from one of the sales pitchs........."the MANHATTAN CLUB, you home away from home" which, in translation for many of us, means HOMELESS.

WHY WOULD OWNERS WANT TO SHUT DOWN SUCH A FANTASTIC PHYSICAL FACILITY? Hi,
I agree that TMC with new management has value. My goal is to shutdown the scam. There are other owners who want their purchase prices refunded and want to make The Manhattan Club the nightmare that they never have to have again. We really need to find out how many TMC owners there are. TMC is a type of ponzi scheme with new owners, maintenance fees and rentals keeping the place going and the developer and his cronies syphoning off huge amounts of cash.
Irene S.
Helen, I don't know if you keep repeating yourself or if the blog format keeps repeating one post, but why would you want to gloat to people who DID purchase one of these units? Why are you even following this topic when you clearly don't have any standing or personal interest in this issue?
We were happy with our ownership until recently, and have had some great vacations in our unit. Hopefully, this problem with availability can be resolved.
Nancy B.
I am an owner who spent over 20,000 and maintence fees for three years and I have been lied to right from the beginning. I want to see TMC pay us back what we have paid as they are not honoring their sales pitch. Can't get reservations as owner when I want to go but if I book as hotel for high price it is available. That's total fraud.
Janice F.
Janice, We are in the same predicament as probably most of the owners. We bought into the timeshare ten years ago with the hopes of using it one, two, or three nights at a time intermittently, during the year as our schedules would allow. However, we were not told that we had to call nine months in advance for a one night or two night stay during the week (bought flex plan timeshare). We never intended to use it for seven nights consecutively. However, we have not been able to use it for seven nights in the years we did NOT trade into RCI. We consistently lost nights every year due to lack of availability of rooms this happened for three years, before we decided to just trade into RCI and go someplace else so we could at least get our money spent on Timeshare (approx. 25K). Not including the escalating maintenance fees and have a nice vacation for a week or seven nights per year. So, as sad as it is, to hear you bought about three years ago, you are just beginning to feel the pain of what it is to be a timeshare owner at TMC. They continue to reel people into their web of deceit and fraudulent sales tactics to get a sale. Are you a resident of NY, or CT, NJ, PA, DE?
Vanessa S.
I am from CT. I wanted for same reason, to use a couple days at a time. I joined RCI this Dec so not to lose the week I was to have 2014. I call Ed about Maintence fees to see when they were do for 2015 as they had my credit card on file, to find out that 2015 fees were charged to my account in Mar 2014. REALLY think they knew AG was coming after them.. I have called each year threatening them of law suit and notifying the State AG. Didn't help.
Janice F.
They have been doing that for years-- not just because of AG- The first year they did it to me I called, had the charge reversed and then withdrew the card so they couldn't try it again. I want to control when I pay not them!
The maintenance fee is due on the anniversary of your contract signing but if you pay it early you can book ahead 9 months from when you paid or 1 year if you book the entire week.

irene, i misunderstood your last message: basically MC owners' goal is to get ian bruce eichner and his gang our of the position of BOSSES OF THE MANHATTAN CLUB, and hopefully get some honest and responsible people to run this really physically fine place to stay when visiting nyc. these BOSSES must be run out of town and out of the timeshare and real estate business. yes "shut down the scam" as you say, but make every attempt to keep THE MANHATTAN CLUB the viable entity it is without the scammers, liars and fraudsters. we paid soundly for the privileges of TMC as we heard the lying salepeople shove the "deals" down our throats. i hope each sales person who assisted in perpetrating this totally fraudulent scheme comes forward as witnesses against eichner and gang. i guess that's wishful thinking, but who knows, maybe scrupulous consciences will prevail. on the other hand, they might just be as guilty and scheming as eichner is.
keep in touch.

I don't care what they do about management at this point. I want my money back! Purchase price and maintenance fees. I am almost 70 years old and I am very upset that they can get away with these dishonest practices. I was deseved big time. I feel that the sales people should be held accountable if they knew they were lying to us. They will say it is new ownership or under new management just to blindside us. But you know as well as me it's the same scum just different names. I want my money back just because of the aggravation I went through trying to book time and to be continually told NOT AVAILABLE!!! They gave me 3 options when they said I could stay in July 2014 and I did not want those days so I lost 7 days again. This is so wrong in so many ways. Not only should TMC have to return our money but there should be legal ramifications for their actions. I would think that what they did is illegal.
Janice F.
Janice,
I agree with you! I don't want to continue being a timeshare owner at TMC! I'm done! I want my money back for purchase price and restitution for outrageous maintenance fees and having to pay more to join the RCI. This is just another way for timeshare companies to get your money. I'd be happy to not have to deal with timeshare ownership at all!
I'll rent a timeshare or hotel! That way I have control over the expense!
Vanessa S.
Janice, What makes you think anything the AG does will get you your purchase money back or correct your credit report if you haven't paid maintianance fees? I'm in the same boat. Robert 788

janice, getting your money back??? don't even think about it or bet anything valuable on that premise. it, in my opinion, simply won't happen..............in this lifetime. there might be some kind of monetary settlement, but even that won't come close to matching what you have lost in actual dollars including the lack of accommodations that you paid for but were unable to use. sorry to be the messenger and bearer of bad tidings, but that's the way it is.................UNLESS THE JUDGE ON THE CASE IS A MC SHAREHOLDER...............FAT CHANCE! ANYWAY, HAPPY, PEACEFUL, HEALTHY NEW YEAR!

Anybody else received a letter like this? Not sure what to make of it? Anne Young
This is very interesting. I've paid my fees so looks like I am stuck I would love to be able to sell this timeshare. The maintenance fees have escalated beyond what I can comfortably pay.
