I had the same offer back in June. My attorney, a NYS bar member, advised me to complete the process and return the papers which I did. This was before the "cease and desist" order from Schneiderman. I have heard nothing in over 6 months and have not received a check for $100.00 either. I have "mentally" written off this loss but really want to see TMC and its owners and Board members held accountable for their actions. I would think that a list of prestigious names, such as was listed for their Board, would not like to be fiscally responsible for TMC but they do have a fiduciary responsibility to the owners whom they are elected to serve. It might be strategically sound to copy them on all correspondence being sent to the AG, the Club or the NYC public defenders. james658

Would you be willing to email me a copy of the letter that you received. It is very interesting that they are still threatening to foreclose when they have been forbidden from doing so by the NY Attorney General's office. I am an owner in the same position as you and have posted frequently on the yahoo group of disgruntled TMC owners. My email is jdp44!@gmail.com

This is very interesting. I've paid my fees so looks like I am stuck I would love to be able to sell this timeshare. The maintenance fees have escalated beyond what I can comfortably pay.

Stay posted to this listserv. redweek.com They will have another installment on the Manhattan Club's twists and turns, including info about a lender threatening to foreclose and a $500K escrow fund established by the Attorney General's office to protect assets, next week. Their excellent reporter, Jeff Weir, reviewed the court documents. This could be huge.

My thinking on this issue of fees is that until the Manhattan Club has been proven guilty, we are still accountable for our maintenance fees. Even if the fees are outrageous and we can't reserve rooms, the Manhattan Club hasn't been proven guilty of fraud.

The point is the Manhattan Club cannot foreclose on any owners. That is what the AG's court order says specifically. The Amnesty for, I believe 37, TMC owners, is owners who were in the process of foreclosure and were given amnesty per the AG's court order. What TMC can still do is file a negative credit report. The AG has been mute on payment or non-payment of maintenance fees.

it appears "The AG has been mute on" many relevant issues. we need to know where we stand, legally, on several still-unexplained issues. SOME PRACTICAL, FINANCIAL GUIDELINES ARE IMPORTANT TO US TMC OWNERS, MR SCHNEIDERMAN. We have been owners since 2007 we upgraded to a one bedroom. It took over a year for them to file our new deed--and only after I sent them a few E-mails. We want to get out of this timeshare, as we can never get the dates we want. I would do what I can to help, Thanks Gary

i will refrain from offering you my opinion concerning your desire "to get out of this timeshare," since it would sound too harsh. the manhattan club honchos have us way beyond over a barrel, and unless schneiderman's lawsuit prevails, we'll continue to be totally and unequivocally screwed by ian bruce eichner and gang. also, in addition to getting the reservation you prefer, also consider the ridiculously exorbitant rise in our maintenance fees. we could probable stay at the plaza (for a shorter time, of course) for what we're paying for one week at the manhattan club.

The Manhattan Club has never disclosed the full list of owners, and there is speculation there are more than 14,000, possibly more than 20,000. It is unclear how many of these owners are aware of the current legal situation, and ways they can assist in the efforts, should they feel similarly.

We are trying to build this page as a centralized resource page for these matters. We have been in regular contact with the New York Attorney General's office, the prosecuting attorney from the last round of litigation in New York, and the resort itself. We are also working with the AG's office to get their direct participation.

If you have more resources or contact info to add to the page, please post here and I will update the page frequently.

PLEASE HELP US build this resource by sharing this link with all other Manhattan Club owners you have contact with. With your help, we can develop a centralized owners list, and make sure all relevant information is shared with as many owners as possible. Good Luck Everybody... Be advised that the new Marriott Vacations Worldwide Corporation is very clever, diabolical; and also extremely INTERESTED in expanding their NYC footprint, based upon customer demand. I'm a former 2.25 year ex-employee from 5/7/12 to 7/30/14 in Hawaii. I won't bother you with my story and I won't commit to studying yours. However, be advised again, there are unethical bastards at that new club. Its not the same old Marriott.

My wife and I received the tax & matanance bill in December. Our contract is up in october how can they ask for payment this far in advance? They say if we don't pay by march we can't book any new day's. Has anyone elese had this situation? We want out of this crazy place.

Gary, they have all kinds of schemes. Several months ago I got a letter telling me I would receive a phone call from the Manhattan Club. I got the call several weeks later and a woman said there were going to be changes at the TMC and I should be aware. She wrote that she would send a representative to my home or we could meet in a place of my choice. I asked the woman if she worked for the TMC and she said no. I had received an e-mail prior to the letter and I had ignored it. My brother is also an owner and I informed him of the email. He made a phone call and was told the woman who sent me the email worked in the Penn office.

I suspect the woman thought I might let her and whomever she was sending to meet with me was interested in "taking the time share off my hands"...;.for a price, I'm sure. I asked her so many pointed questions that she hung up on me. LOL

BTW, who is Johnathan? I thought a group had already gone the attorney route some time ago and got no results. $500. from each owner for MAYBE a seat at the AG's table???

My contract is Dec and they charged my credit card for 2015 in March 2014. I canceled my credit card a they can't do it again this coming March. I can never get days I want anyway. Never got my days for 2014. They only had 3 days 1 at a time in July when I tried to book and they said not available. I just don't know what we can do. I just want something done. This is so NOT RIGHT!

philj47, not sure of the point of your message in this MANHATTAN CLUB forum. certainly the entire timeshare industry has more than its share of unethical and unscrupulous principals and sales personnel. few in this industry seem to have any moral standards or interest in people they maim financially or otherwise. i own shares at the MANHATTAN CLUB, a beautiful respite when i'm in manhattan, but as for getting desired reservations and the exorbitant maintenance fees, well as they say in brooklyn, "FUGGETABOUTIT." MANAGEMENT IS UNETHICAL AND UNSCRUPULOUS, AND A BUNCH OF SELF-SERVING SCHEMERS AND SCAMMERS. I WOULD NEVER BUY A TIMESHARE AGAIN, ANYWHERE, IN THIS LIFETIME, OR, IF THERE IS ONE, IN MY NEXT LIFETIME.

I just spoke with Lynne O'Donnell at TMC 212-453-8155. She has list of those wanting to deed back their units. Nothing can be done until the AG finalizes the case. She told me anything related to non- payment of 2015 maintenance fees has to be worked out thru fin. services. Has any of you worked out a non- payment agreement with Fin Serv ?
