Any TMC owners in Central Florida?

MC owners who may be in the Central Florida area next month please note that the NTOA is having their first Regional Meeting of 2015 on Sunday, February 8th.

This is a great opportunity to network about and spread word on The Manhattan Club Scam.

The meeting is being held in The Villages. The Villages community is an hour north of Orlando, Florida. There will be speakers on HOA, sales and rental issues. There will be representatives from exchange companies and some of the NTOA’s partners on hand as well. Non-NTOA members can attend for $25 per person which can be applied to the cost of an annual NTOA membership prior to close of meeting, but there is no need to become a member if they don’t want to. I called Lynne and she said that the list of owners are those folks willing to GIVE BACK their properties to TMC FOR FREE to get out of paying the maintenance fees. Are there 10 or more of us out there in California for a possible class action suit?

I would like to join law suite also. I am a widow and can't beleive I let these crooks cheat me out of over $21000. The stress is killing me. Lost all last years days and 1 year before but when I did go it was when they said I could go.

Although we don't have a lot of control over the lawsuit, itself, as owners we do have some say about how the Manhattan Club runs it's business. Also, officers can be voted down, etc. Does anyone have any insights about how to organize owners to approach the problem this way?

Several are from CA. But not sure the class action suite is the solution. The AG in New York investigation is on-going. I stopped paying maintenance fees a few years ago when I could not get time. A law firm hired by TMC threatened foreclosure which appears to be on hold. They never returned my calls. They hit my credit but appears to have disappeared recently from my credit after AG got involved. This should help us too. Any comments.

Chris, I agree. They want their maintenance fees first. Then, they may talk to you about "giving" back your timeshare. But, that happens with another dept. and it's at their discretion what may or may not occur. I have been told so many different things that I don't trust what any of them (TMC employees say). We didn't trust that they would honor the "give back for $1.00, after paying the 2014 fees. I felt it could be another ploy to get maintenance fees upfront (5-6 months before they were due). How can you trust such people with anything that is promised. We won't pay them another cent until something is done.

vanessa, nyet, non, nay, no (and in any other language) to paying the greedy, thieving, scamming frauds another penny in maintenance fees (NY TAXES MUST BE PAID. DEMAND THE FINANCIAL SERVICES OFFICE SEND YOU A TAX BILL FOR EACH WEEK YOU OWN.) i will not sent TMC another maintenance penny until and IF the new york attorney general prevails in the court case. at that point i will decide a course of financial action.

In my experience TMC begins their process of collecting maintenance fees about April of the preceding year via mail & telephone, so when collecting for 2016 they actually want it paid in full at midnight on Dec 31, 2015. If not they warn that come January there is a 16% penalty for the unpaid balance per month.Mine was $2100. for 2014. If they have your debit or credit card number handy they blind side you & take the fee at their convenience. What a surprise when you didn't count on that for that months budget. Lets face the costly mistake made here by many. They "wine & dine" you with free parking,restaurant vouchers & Broadway tickets to get you to sign away on legal documents that represent a real estate deal in court just like your house(mortgage,maintenance & real estate taxes).In reality you just bought "time" not property.Around 2-3 weeks later you receive this 5 lb "War & Peace" sized book written in "legalese" that is designed to protect TMC from you the "owner" in court. On the cover of the book it states "This offering contains a high degree of risk".In fact the moment when you sign off on it & go home its similar to buying a new car and driving off the dealership lot it just started to depreciate. Some of the sales people remind me of used car salesmen.I'd like to see timeshare go the way of the VCR & 8track Tape. The bottom line is if you want to vacation just call the hotel yourself and book it for whatever day or time of year you desire. Best wishes to unhappy "owners".

I tend to agree with what Janice wrote on 1/16/15 and what Sharon wrote on 1/22/15. I can never use my TMC timeshare and am sick of paying the exorbitant maintenance fees AND the mortgage. I've decided to close my checking account from which TMC makes electronic funds transfers for my payments when due, and just stop paying for everything. I'm paid up on maint. fees, and was told mine won't be due again until Jan 2016. If I stop making the mortgage pymts, I assume TMC will take action to foreclose, as Sharon said. Do I care? I've been paying for 10 years, I can't use it, don't want it, and can't see any other way out. I know my credit rating will take a hit, but I believe it's worth it to escape from this expensive scam. Any thoughts or advice before I pull the plug? One other thought: with 14,000 owners (per the NY AG) paying approx. $2500/year, TMC is making $35million in maint. fees only each year - and it keeps rising. No wonder they care more about the maint. fees than the mortg. pymts!

for your consideration: before taking any "escape" actions, wait for the results of the lawsuit. it might be worth it financially. as a owner i fully understand your concerns, frustrations and the nasty feeling of being cheated. "been there, done that." but, who knows, revenge might be sweet thanks to the possibility of our WINNING THIS COURT PROCEEDING.

Thanks, Chris, you're probably right. I guess I'd better wait. But wasn't this lawsuit started in 2011? Any idea as to when it will be over? Do you know where I can read up on/get details of this specific lawsuit? What, exactly, is the lawsuit asking for: compensation for lost weeks? to allow owners out of their contracts? reduction of maint. fees? stop booking hotel stays for non-owners? I mean, what's the objective of the lawsuit? What is the revenge? Sally

this msg for sallyw109....about the date of this lawsuit.....THIS PARTICULAR SUIT WAS BROUGHT AGAINST TMC LAST YEAR BY OUR NY STATE ATTORNEY GENERAL, ERIC SCHNEIDERMAN (and it seems to be proceeding at less than a slow snail's pace.) the cases begun in 2011. we were represented by a private attorney, blau & blau i think. they had 2 or three presentations in court and all were dismissed. THE CURRENT LAWSUIT DESCRIBED ABOVE (NYS ATTNY GEN) is not connected in any way with blau and blau.

Thanks, Chris, for the update. I'm glad to know it's not the 2011 lawsuit we're still waiting on, and too bad we lost it. Tho, I still don't know what the law suit was about, so what did we lose? I read that the NYS AG called TMC timeshare practices a "bait and switch game," so I assume his ls is trying to address the inability of ts owners to book their purchased weeks. Do you know of any site that gives details of the AG's suit, particularly what it is that the AG is suing TMC for; i.e., what do we get if he wins?

I thought I asked a reasonable question. I belong to other forums that are better organized. People here ask the same questions because they could not find the answers given multiple times. So a little reorganization doesn't seem to be out of line or crazy.
