If anyone can figure out a way to bring a legal case against Rancho Bandera et al. please let me know!

At the time that I bought my timeshare in 1998 (paid in full), my maintenance was $460 a year -- two years ago it was over $1600 a year. I have since decided not to pay any more fees (primarily because I had not been able to book at the resort since 2008). At that time, I was placed so far in the back that I left and checked into a hotel in downtown PV at considerable additional expense.

Then out of the blue several days ago, I started getting calls from a company saying that I would be paid $29K for my timeshare of 960 points provided I acted within 10 days.

I decided to check out the company "Holiday Property Management" (www.holidaypropertyintl.com) out of Dayton, OH and noticed the site was under Vacation International Inc. which, to my surprise, led back to Fairmont!

It looks like some type of resale scheme (or possibly worse) is afoot. I would appreciate any information anyone may have about this latest development.

Also, I wonder if anyone has contacted PROFECO concerning this resort?

I tried lodging a complaint with Canada's Better Business Bureau to no avail. We are all looking for a way to prove and prosecute!

I like several others have been a victim of this company. I do however have a question of anyone out there. I also have received a call from Holiday property management with an offer to purchase my points at Rancho. Has anyone gone through with this? I would also like to be part of any legal action that can be taken.

Holiday Property Management is a fraud. We've been contacted several times by this "company" offering us an exorbitant amount of money for our timeshare. There is a legitimate company by this name, but the contact info and telephone numbers are completely different. When we called the management of our time-share, we were told they've had many complaints about fraud from "Holiday Property Mangement". Do not give them any information!!

It sounds like there has been a lot of misunderstanding and buyer's remorse on this forum.

We too have never had issues with Rancho Banderas. It is a very popular resort, always booked at least a year in advance. You MUST reserve your time a full year in advance or your will not get the dates you desire. We have 720 points and have never had any difficulty using our time, once we learned the system.

When we were down there last month we talked to several folks looking to purchase MORE points, as well as one couple who were trying to sell part of their their 2000+ points in 480-600 point increments. Some friends of ours purchased 600 points from them for $2000! If you are interested in selling, buyers are out there. But at least try to get something for your investment. A sales trip to Rancho or posting sales online could definitely put some money back in your pocket!

Holiday Property Management would like you to consider the following resale proposal of your Rancho Banderas vacation property.

Owner(s): Resort: Rancho Banderas Unit/Points: 240 Season: Exchange Company: Purchase Price Offer: $16,900USD

We at Holiday Property Management (Here there after know as HPM). GUARANTEES the purchase of the property mentioned above. HPM will act as an intermediary on behalf of the buyer and the seller. Before, the property can be transferred in to the new owners name, based on the payment of ($16,900USD),a statement must be received from the seller, prior to receiving payment, stating that there will be no other charges for services rendered from neither HPM nor any of its agents.

HPM GUARANTEES the sale amount of ($16,900USD) will be paid to the owner(s) after the transfer of ownership has been completed, and all parties have been satisfied. This information is provided by the registered owner at each independent resort. HPM assumes all information to be accurate and true to the best of the owner ́s knowledge. It appears that these "companies" eventually ask you to pay some kind of transaction fee in order to receive payment (which I assume is never paid, hence the scam). According to Northwynd, there are a great many of these scams which they tend to leave to the individual resorts to deal with.

I filed with Profeco and after 2 years Rancho did not respond to Profecos meetings or request. Profeco told me I can now take them to court.

I also paid in full for my timeshare in year 2001. The maintenance fees got so ridiculously high that I stopped paying, a couple of years ago. I think my timeshare is lost by now. I could not handle their thievery any more. Peter Deutsch

It took a lot of time and work but PROFECO was instrumental in my reaching a settlement with another timeshare company on a different issue. I learned that Mexico does not have the equivalent of a "class action" category -- court cases are reviewed on an individual basis. PROFECO (which is not a court) does not have enforcement powers but can be helpful when the company in question admits wrongdoing and agrees to make restitution, etc. Would your next action involve PROFECO or the Mexican court system and what would be the basis of the case? Hello,

We had a nearly identical letter from HPM and the offered resale price they offer us seems to good to believe. We have been forwarded an exclusive re-sale contract for our Playa del Sol fractional and we are trying to find out if this is a scam and if so how it works. We have been told that Reliance Escrow Services (Houston) will be used as the intermediary company for the resale. We can't find anything negative about this company on the web so also ask if you or anyone have info on this company. Have you had any feed back from your inquire in regards to HPM? Thanks, Mike

It is a scam....you can buy a time share for $1 on this site. Don't do it!

My mother got a few calls out of the blue in the last week from this holiday joint. I told her to hold off and not sign anything (big duh). She had all her timeshare paperwork layed out (for Playa Del Sol), wondering if this is something she should jump on. Big no. The old rule of thumb: If it sounds too good to be true, it probably is.

Also, if that email was the exact copy paste, that should be an indication in itself that this is just another marketing scheme and not even a good one. Seriously, the opening sentence wasn't even a sentence. Neither was the second one. The whole 1st paragraph was full of errors. Cripes, if you're going to sell me something, at least present it in a professsional way that makes it seem ligit.
