we have worked this out and wew no longer have issues with grand Mayan.

The only way to get out from under a MX developer bought timeshare is if the 5 day rescission period is not listed in your written contract .... it's law that the rescission period be listed. If the 5 day rescission WAS listed in your contract and you didn't rescind during that timeframe then you're out of luck legally.

I wish you luck, but no lawyer on earth can get you out of a legally binding and signed (by you) contract unless fraud was involved. If you can prove fraud then, yes, you'll have a legal leg to stand on. If not, then you're out of luck ... no legalese jargon included.

Then it would seem you have a legal leg to stand on if you tried to rescind during that 5 business day timeframe, but you'll need proof that you tried to rescind during that timeframe ..... just saying you tried to rescind won't work unless you have written proof to back it up .... in other words, do you have a copy of the rescission letter that you sent stamped by USPS.

Are you saying that you recorded the presentation and that you rescinded within the 5 day rescission period? If so, I don't understand what your dilemma is.

If you're saying that there is no UPS in Mexico .... you would not send a rescission via UPS you would send it via the United States Postal Service or, if you were still in Mexico, you could have rescinded in person or via the Mexico postal service.

I hope you're not paying your attorney a lot of money to try to get you out of this contract, because I don't see that you have a legal leg to stand on if you didn't rescind within the 5 day rescission period UNLESS the rescission period was not in your WRITTEN contract.

Even though you were in MX for 2 weeks holds no legally binding excuse for not rescinding within the 5 day timeframe.

We bought Mayan Mazatlan. Within 24 hours, we COMPLETELY and PROPERLY filed the "5-day-law" paperwork. The Mexican Federal Government in Mexico City (Federal Consumer Protection Agency, Department of Conciliation Services for Foreign Residents) took up our case and for 2.5 years met with and fined the Mayan TS. Mayan never paid a penny!!! Finally, the Federal Government Agency gave up and said "your file will be closed without prejudice to you rights in case you decide to take the matter to the Mexican Tribunal." I do not know what to do next??? Can anyone out there help us????
