Can you sell or rent Grand Luxxe Residence Weeks?

Mar 18, 2014

Folks who buy time at the Grand Luxxe sign two Agreements, one for the Registered Week(s) and another for the Residence Weeks. For every Registered Week time bought you generally also receive use of two Residence Weeks. The Residence Weeks Agreement is different from the Registered Week Agreement. The Residence Weeks Agreement make it clear that what we are paying for is only the Registered Week(s) and the Residence Weeks are provided by the developer without cost to us. In the Residence Weeks Agreement, which is not a confidential document, it states in item 10 C. that this program is not intended for any rental, resale or commercial purpose. The Residence Week(s) Agreement also states that these weeks can only be transferred to the members immediate family or heirs. Question: Does that language in the Residence Weeks Agreement prohibit the sale or rental of a member's residence weeks? A second question is can the addenda (all contacts give extras in addenda) be transferred in a sale of Registered Weeks? The Registered Week Agreement in Clauses #6 states that all addenda granted to member in connection with the contract shall terminate if it is sold.
