Rescinding Vacation Club membership
Hello,
We wonder whether anyone experienced having a contract that has no cancellation clause in Mexico. We are in the requested the cancellation of the vacation club membership and they tell us that they will give us partial refund (they insist charging us for the room and the service, as we got moved to the member section during our stay there. However such deduction is not written in the contract.) since we are cancelling outside of the 5 day grace period (cancelled on the 7th day and we were not aware of this 5 day grace period.). However, our contract does not have cancellation clause anywhere. I am 100% sure that we did not sign any paper other than what we currently have that has cancellation clause in it.
We wonder whether this (not having a cancellation clause) will make this contract null and void or illegal. Or it doesn't matter because it is not 'timeshare' but 'vacation club'?

A lot of these vacation clubs (especially in Mexico) make you sign a waiver waiving your rights of rescission. Those are invalid. You always have a right of rescission. That's just a scare tactic they use hoping you don't find out that you have that right.
It appears that you have passed your rescission period. What you might want to do is contact customer service and demand cancellation persistently. Sometimes they will grant your request if you agree to come back on these boards and humbly admit that the company resolved your issue to your satisfaction. The other thing you can do is threaten to not pay another dime in mortgage and/or maintenance fees and, therefore, it would be in the best interests of everybody involved to rescind the contract.
Of course, the biggest warning is to never ever pay anyone a large, upfront fee to sell, rent out, market, or cancel your timeshare (or vacation club). You might start getting phone calls from scam operations claiming they have buyers wanting to pay you big bucks for your unit. They will get you all excited and then demand an upfront fee from you for some bogus reason.
